Terms of Service

These Terms of Service (the “Terms”) are a binding agreement between you and Flypify, a product of PositivityTools, a DBA of TFT GROUP LLC (“Flypify,” “we,” “us,” or “our”). They govern your use of flypify.com, the Flypify web and mobile apps, and the Flypify API (including the MCP endpoint) — together, the “Service.”

1. Acceptance of these terms

By creating an account or otherwise using the Service, you agree to these Terms and to our Privacy Policy. If you are using the Service on behalf of a business, you represent that you are authorized to bind that business to these Terms. If you do not agree, do not use the Service.

2. The Service

Flypify surfaces curated TikTok Shop product research — including estimated revenue, units, margins, saturation, and trend signals — to help you make product decisions, and lets you push products as drafts to a connected Shopify store. The research is compiled from licensed third-party market and sourcing data and is provided for decision support only. We may change, add, or remove features over time.

3. Eligibility and accounts

You must be at least 18 years old to use the Service. You are responsible for the accuracy of your account information, for safeguarding your credentials and API keys, and for all activity under your account. Notify us promptly of any unauthorized use. We may suspend or terminate accounts that violate these Terms.

4. Subscriptions, billing, and renewal

Flypify offers paid subscription plans. As of the effective date, pricing is:

  • Pro$49/month or $490/year.
  • Shipper$125/month or $1250/year.

Paid plans are billed in advance through Stripe (or, for purchases made in a mobile app store, through that store) and renew automatically for the same term until you cancel. Prices are the same whether you subscribe on the web or in the app. We may change prices on a going-forward basis; we will give you notice, and changes take effect at your next renewal. You authorize us and our payment processors to charge your payment method for each renewal.

You can cancel anytime from your account (for app-store purchases, through that store). Cancellation stops future renewals; your access continues until the end of the current billing period.

5. Refunds

Subscriptions are billed in advance. Within 14 days of your first subscription charge you may ask us to refund that charge. Where you have a statutory right to withdraw from the purchase, that refund is your right and not our decision; where no such right applies, we will consider the request at our discretion. Outside that window, and for every renewal charge, subscription payments are non-refundable, including for partial billing periods: the core value of the Service — a winner's supplier link, landed cost and margin — is delivered the moment it is revealed to you. You can cancel anytime to stop future renewals; your access continues until the end of the current billing period.

One-time credit packs are a prepaid balance rather than a subscription, and are treated separately. Credits are not converted back into money: an unspent pack is not refunded in cash, and neither is a credit you have already spent, because spending one commissions work from an outside provider that we pay for either way. Where credits do come back, they come back to your balance, and that is the only way a credit comes back. Credits you buy do not expire with time, but if you close your account, your access ends and any credits still on your balance end with it — including credits you bought, which are not paid back in money. Spend them before you delete. Credits granted with a plan end with the plan.

Refunds for purchases made through a mobile app store are handled by that store under its policies. Nothing in this section limits any non-waivable rights you may have under applicable law. Our Refund Policy explains how to ask and what we need from you, and our Credit Policy sets out when credits come back to your balance automatically. Where either could be read differently from this section, this section governs.

6. API and MCP terms

Paid plans include access to the Flypify API and MCP endpoint, which let you use Flypify from an AI agent or other software. Your use of the API is subject to these Terms and to the following:

  • Rate limits. The API enforces per-plan usage limits (for example, daily call caps and reveal/draft budgets). Do not attempt to circumvent or exceed them.
  • Keys. Keep your API keys confidential. You are responsible for all activity under your keys; we recommend rotating a key if you believe it is compromised.
  • Licensed use only. The product data made available through the Service and the API is licensed to you for your own product-research and store-building use only. You may not scrape, crawl, bulk-export, cache beyond normal operation, redistribute, resell, sublicense, publish, or otherwise make the data available to any third party, and you may not use it to build, train, or improve a competing dataset or product.

These restrictions protect the licensed data that powers the Service. We may suspend or revoke API access for any violation.

7. Acceptable use

You agree not to:

  • use the Service for any unlawful purpose or in violation of any third party’s rights;
  • scrape, crawl, bulk-extract, resell, or redistribute Flypify’s data or content;
  • reverse engineer, decompile, or attempt to extract source code, except to the extent the law expressly permits;
  • probe, scan, or test the vulnerability of the Service, or breach its security or authentication;
  • interfere with or disrupt the Service or the infrastructure it runs on;
  • share, sell, or transfer your account or access keys to anyone else;
  • upload, or direct the Service to generate, the face, likeness, voice, or performance of any person without that person’s permission;
  • present generated output as the genuine, unpaid endorsement of a real person.

Material you provide, and likeness and voice. The Service generates advertising creative from what you give it. By uploading an image, audio, video, or other material, or by directing the Service to generate output from it, you represent and warrant that you hold all rights and permissions necessary to do so — including, where any identifiable person’s face, likeness, voice, or performance appears, that person’s consent to its use in commercial advertising.

You are the advertiser. You are responsible for how the output is used and for any labelling or disclosure required by the advertising platform you publish on or by applicable law, including any requirement to identify content as AI-generated. Flypify does not obtain these permissions on your behalf and cannot verify them.

8. No earnings guarantee; data accuracy

Flypify is a research and productivity tool. It is not financial, investment, or business advice, and it is not a guarantee of income or results. We do not promise that you will make money, achieve any particular sales, or that any product will be profitable. Outcomes depend on many factors outside our control, including your own execution and market conditions. Any examples, figures, or testimonials are illustrative; results are not typical and are not guaranteed.

The estimates and signals we surface are derived from third-party data and modeling and may be incomplete, delayed, or inaccurate. We provide them “as is” for decision support; you are responsible for your own due diligence before acting on any data in the Service.

9. Intellectual property

The Service — including its software, content, design, and branding — is owned by us or our licensors and is protected by intellectual-property laws. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your internal business purposes. You retain ownership of the content you create in your own store; you grant us the permissions needed to operate the Service on your behalf (for example, to push a draft product to your connected store).

10. Third-party services

The Service integrates with and references third parties — including Stripe (payments), Shopify (store connection and product publishing), AliExpress (product sourcing), and TikTok / TikTok Shop (the marketplace our research describes). Your use of those services is governed by their own terms and policies, and we are not responsible for them. Flypify is not affiliated with, endorsed by, or sponsored by TikTok, Shopify, AliExpress, or any other third party named in the Service.

11. Disclaimers and warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, error-free, or that any data will be accurate or complete, to the fullest extent permitted by law.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FLYPIFY AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOST PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100). Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

13. Indemnification

You agree to indemnify and hold harmless Flypify and its affiliates, officers, and employees from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your use of the Service, your content, or your violation of these Terms or applicable law.

14. Termination

You may stop using the Service and cancel at any time. We may suspend or terminate your access if you violate these Terms, if required by law, or to protect the Service or other users. On termination, your right to use the Service ends; the sections that by their nature should survive (including ownership, disclaimers, limitation of liability, indemnification, and governing law) will survive.

15. Governing law and disputes

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-law rules. The exclusive venue for any dispute arising out of or relating to these Terms or the Service will be the state and federal courts located in Florida, and you consent to that jurisdiction.

16. Changes to these terms

We may update these Terms from time to time. When we do, we will revise the effective date above and, where the changes are material, take reasonable steps to notify you. Continued use of the Service after changes take effect means you accept the updated Terms.
